ITALIAN CITIZENSHIP THROUGH MARRIAGE
RECOGNITION OF ITALIAN CITIZENSHIP FOR PEOPLE OF ITALIAN DESCENT BORN IN THE USA, OR IN ANOTHER COUNTRY WHERE CITIZENSHIP IS ACQUIRED BY BIRTH.
IN ORDER TO SUBMIT YOUR APPLICATION TO THIS CONSULATE, YOU MUST BE A RESIDENT OF ONE OF THE FOLLOWING STATES: CALIFORNIA (except San Luis Obispo, Kern, San Bernardino, Santa Barbara, Ventura, Los Angeles, Riverside, San Diego, Imperial Valley, Orange Counties), ALASKA, HAWAII, IDAHO, MONTANA, OREGON, UTAH, WASHINGTON STATE, the administrative territory of the Islands of Caroline, Yap, Marianne (Legal Aliens must show proof of their Alien Registration Card or Employment Authorization Card). Residents outside the above jurisdiction must present their application and documentation to the Consular Authority under whose jurisdiction they reside.
If you were born in the United States (or in any other Country where citizenship is acquired by birth), and any one of the situations listed below pertains to you, you may be considered an Italian citizen. For each category, all conditions must be met.
1) Your father was an Italian citizen at the time of your birth and you never renounced your right to Italian citizenship.
2) Your mother was an Italian citizen at the time of your birth, you were born after January 1st, 1948 and you never renounced your right to Italian citizenship.
3) Your father was born in the United States, your paternal grandfather was an Italian citizen at the time of his birth, and neither you nor your father ever renounced your right to Italian citizenship.
4) Your mother was born in the United States, your maternal grandfather was an Italian citizen at the time of her birth, you were born after January 1, 1948, and neither you nor your mother ever renounced your right to Italian citizenship.
5) Your paternal or maternal grandfather was born in the United States, your paternal or maternal great-grandfather was an Italian citizen at the time of his birth, neither you nor your father/mother nor your grandfather/grandmother ever renounced your right to Italian citizenship (please note: a grandmother born before 01/01/1948 can claim Italian citizenship only from her father and can transfer it only to children born after 01/01/1948). If this is not clear please contact the Italian Consulate before submitting your application.
Assistance in obtaining all required documents can be provided by some private agencies. The Italian Consulate has no affiliation with such agencies nor can endorse their services.
NOTE: “Italian citizen at the time of birth” means that he/she did not acquire any other citizenship through naturalization, before the descendant’s birth.

IF N. 1 APPLIES TO YOU, YOU MUST OBTAIN THE FOLLOWING DOCUMENTS, ALL IN ORIGINAL:
1) YOUR FATHER’S BIRTH CERTIFICATE (write to the “Comune” where your father was born, request a birth certificate in “formato internazionale”, or in “estratto per riassunto”(showing his father’s and mother’s names), enclose three/four dollars for S&H and a self-addressed envelope. When writing to the Comune, address your request to :

2) YOUR MOTHER’S BIRTH CERTIFICATE (see above, or, if she was born in the U.S.A., request a “certified copy” or a “long form” or a “full form”;
3) YOUR PARENTS’ MARRIAGE CERTIFICATE (if the marriage took place in Italy, follow the procedure above). If it took place in the U.S.A., you must obtain a “certified copy” of the license and certificate and an APOSTILLE from the Secretary of State of the State in which it was issued. (APOSTILLE: information will follow)
4) YOUR FATHER’S CERTIFICATE OF NATURALIZATION or his Italian passport and permanent resident card (“green card”).
If the above is not available, you must request the following:
A) a statement from U.S. Citizenship and Immigration Services, U.S. Department of Homeland Security, P.O. Box 648010, Lee’s Summit, MO 64064-8010, and from the County in which he resided.
The statement must show his full name (and any other names he went by on any official documents), place of birth and date of birth, date of naturalization, and certificate number (or, if a legal alien, his permanent resident card number).
B) If the research shows no record, you are requested to double-check with the “National Archives” ( www.archives.gov )requesting a full search under his name and nickname, and possible dates of birth which he may have declared. If the record is found, you will obtain from the National Archives a certified copy of his “petition for naturalization” and “oath of allegiance”. (Please note: this Office may at anytime request that you present documentation from the National Archives – in case of discrepancies – to confirm the identity reported on the certificate of naturalization).
C) If the record is still negative, you will need to check with the CENSUS, requesting a survey report dated after your date of birth, if your father was born in Italy. In the cases of categories 2,3,4 and 5, the survey report must, of course, be dated accordingly – i.e. covering the period of the Italian-born ascendant’s child’s birth.
5) YOUR BIRTH CERTIFICATE (you must obtain a “certified copy” a.k.a. “full form” or “long form”, with an APOSTILLE from the Secretary of State of the State in which it was issued. (APOSTILLE: information will follow);
6) YOUR DECLARATION THAT YOU NEVER RENOUNCED ITALIAN CITIZENSHIP BEFORE ANY ITALIAN AUTHORITY, LISTING ALL YOUR PLACES OF RESIDENCE.
7) COPY OF YOUR PASSPORT AND DRIVER’S LICENSE.
8) YOUR FATHER’S DEATH CERTIFICATE (if applicable) (in certified copy and legalized with Apostille) OR HIS CURRENT ADDRESS.
IF YOUR FATHER BECAME A NATURALIZED U.S. CITIZEN BEFORE YOUR BIRTH, YOU ARE NOT ENTITLED TO ITALIAN CITIZENSHIP (unless you fit into another category);

PLEASE NOTE CAREFULLY:
ALL CERTIFICATES MUST BE IN “CERTIFIED COPY” A.K.A. “LONG FORM” OR “FULL FORM” OR “BOOK COPY” (NOT “CERTIFICATION” OR “ABSTRACT”). SAID FORMS CAN BE OBTAINED AT THE VITAL STATISTICS OFFICE OF THE STATE IN WHICH THE BIRTH/MARRIAGE/DEATH TOOK PLACE.
CERTIFICATES REPORTING ONLY THE “COUNTY” OF BIRTH CAN NOT BE ACCEPTED. YOU MUST REQUEST THE VITAL STATISTICS AUTHORITY TO STATE THE CITY OF BIRTH.
APOSTILLE: U.S. BIRTH/MARRIAGE/DEATH RECORDS RELATED TO THE “ITALIAN SIDE” MUST BEAR AN “APOSTILLE” (ACCORDING TO HAGUE CONVENTION OF DEC. 5, 1961) OF THE SECRETARY OF STATE OF THE STATE IN WHICH THE DOCUMENT WAS ISSUED, (EXCEPT FOR THE CERTIFICATE OF NATURALIZATION AND/OR SIMILAR DOCUMENTATION).
THE APOSTILLE is the legalization provided by the Office of the Secretary of State of the State where the document/certificate is issued (Please note: it is not a stamp on the certificate. It is legalization, a document stapled to the birth/marriage/death certificate by the Secretary of State).

ADDITIONAL REQUIREMENTS FOR ALL CATEGORIES:
1) If you are married, you must also submit your marriage certificate (license and certificate, in certified copy and legalized with the “Apostille” of the Secretary of State) along with a copy of your spouse’s birth certificate.
2) If you have children under the legal age (under 18) you must also submit a certified copy of your birth certificate/s, legalized with the Apostille of the Secretary of State.
3) If you are a male under the age of forty-five you will have military obligations to Italy, which can generally be fulfilled by completing the necessary paperwork in the pertinent Consulate after your citizenship has been processed. However, if you are under the age of twenty-seven until you reach that age you may not permanently reside in Italy for reasons other than study unless you wish to serve in the Italian Armed Forces. Further information on military obligations can be obtained by contacting the military section of the pertinent Italian Consulate or Embassy, depending on where you are residing.
4) Birth, marriage, divorce, and death certificates in languages other than Italian, relating to the “Italian side” and to the applicant must be translated into Italian. The only document relating to the ancestor born in Italy that does not need to be translated and does not need an “Apostille” is the U.S. Certificate of Naturalization or any statement releasing information on the naturalization status of the interested party.
“Apostilles” do not need to be translated.
Documents issued in Countries other than the U.S.A. must comply with the local regulations on the legalization of documents, they must be translated into Italian and the translation certified by the Italian Consulate/Embassy in the Country where the documents were issued (for further information, you may contact any Italian Embassy/Consulate in the world by logging on to the pertinent web sites. · DISCREPANCIES:
Check all documents word by word to make sure that there are no discrepancies or changes in the names, last names, dates, and places of birth. If there are minor discrepancies in first and last names, please contact this Office before presenting your application. If there are major discrepancies in last names, dates, ages, and places of birth these variations or errors must be corrected with an official “affidavit to amend a record” to be requested from the Vital Statistics Office that issued the document or with another appropriate official document.
Please prepare a typed list of all the discrepancies that you find in the documents. This is required for the Citizenship Office to process your request.
· Please bring a xerox copy of a valid I.D., showing your current address, and on the application form mention the Comune in Italy requested for the registration of your documents. It could be either your ancestor’s Comune of birth or the Comune where you intend to establish your residence.
· PLEASE BE ADVISED THAT THE PROCEDURE CAN BE COMPLEX AND VERY LENGTHY. THIS OFFICE WILL NOTIFY YOU IN WRITING AFTER YOUR DOCUMENTATION HAS BEEN PROCESSED.

INFORMATION ON ITALIAN CITIZENSHIP THROUGH MARRIAGE
(Art. 5, Legge 5 febbraio 1992, N. 91)
· A foreign woman who married an Italian citizen before 04.27.1983 automatically acquired Italian citizenship. (Law n. 555/1912 granted Italian citizenship by marriage to women only).
· Law n.91 of February 5, 1992 states that the male or female (foreign or stateless) spouse of an Italian citizen may apply for Italian citizenship after he/she has legally resided in Italy for at least six months, or after three years from the date of marriage if he/she resides abroad, by presenting a request for naturalization accompanied by the following documents:
1) APPLICATION addressed to the Ministero dell’Interno, Roma.
2) BIRTH CERTIFICATE of the applicant. If the applicant was born in the United States this must be a “certified copy” “long form” or “full form”, with an “APOSTILLE” (legalization issued by the Secretary of State), accompanied by a translation into Italian. For birth certificates from other countries please see the second page of these instructions.
3) ESTRATTO PER RIASSUNTO DELL’ ATTO DI MATRIMONIO issued by the Italian Comune. Parties married outside of Italy who have not had their marriage certificate recorded in Italy by the Italian Consulate with territorial jurisdiction over their place of marriage must present their certificate to the competent consular authority, requesting its registration in Italy, and subsequently obtain the “estratto per riassunto dell’atto di matrimonio” from the Comune, before presenting their application (please be aware that this may take a varying number of months, depending on the Consulate and on the Comune).
4) CERTIFICATE OF RESIDENCE OF THE APPLICANT. (“Sworn affidavit” concerning residence during the last three years, listing addresses and family members living in the same household (women must give their maiden name). The affidavit must be a statement prepared by the applicant, signed in front of a notary public, legalized with an APOSTILLE, and accompanied by a translation into Italian).
5) CERTIFICATE OF CITIZENSHIP OF THE ITALIAN SPOUSE (this will be issued by the Consulate of residence at the time of application).
6) “CERTIFICATO DI STATO DI FAMIGLIA” (same as above).

7 7A) “Police clearance” or “Certificate of criminal records”, issued by the central Authority of each State of which the applicant has been a resident since the age of 14. The certificates must be originals, with APOSTILLES, accompanied by translations into Italian (for certificates issued in California a sample translation form is enclosed).

8) VALID PASSPORT AND PHOTOCOPY OF PAGES CONTAINING PHOTOGRAPH AND OTHER INFORMATION (The copy will be certified by the Consulate).
AN APPOINTMENT MUST BE SCHEDULED WITH THE CITIZENSHIP DEPARTMENT OF THE CONSULATE TO PRESENT THE APPLICATION FOR ITALIAN CITIZENSHIP AND ALL REQUIRED DOCUMENTATION IN PERSON. THE APPLICATION MUST BE SIGNED IN THE PRESENCE OF AN OFFICIAL OF THE CONSULATE.
DOCUMENTS WRITTEN IN A LANGUAGE OTHER THAN ITALIAN NEED TO BE LEGALIZED IN ACCORDANCE WITH THE REGULATIONS EXISTING IN THE COUNTRY WHERE THEY WERE ISSUED AND THEY MUST BE ACCOMPANIED BY AN OFFICIAL TRANSLATION INTO ITALIAN CERTIFIED BY THE ITALIAN DIPLOMATIC/CONSULAR AUTHORITY WITH JURISDICTION OVER THE COUNTRY IN WHICH THEY WERE ISSUED.
CONSULAR FEES RELATED TO THE APPLICATION AND TO THE CERTIFICATION OF DOCUMENTS WILL VARY DUE TO THE FLUCTUATION OF THE RATE OF EXCHANGE AND TO THE NUMBER OF DOCUMENTS TO BE CERTIFIED. FEES ARE GENERALLY AROUND $100.00 AND MUST BE PAID IN CASH AT THE TIME OF APPLICATION
