INSTRUCTIONS FOR RECORDING A UNITED STATES MARRIAGE, BIRTH, OR DEATH CERTIFICATE IN ITALY

In order to have a United States marriage, birth, or death certificate recorded in Italy, please complete one or more of the attached forms and return it to this Consulate General with the certificate or certificates that need to be recorded. The certificate must be a “certified copy” issued by the appropriate United States authority (see n.1) and it must have attached to it an “Apostille” from the Secretary of State of the state in which it was issued (see n.2). The “apostille” is the international authentication of the signature of public officials, adopted by the countries that signed the Hague Convention.

In summary, the procedure is as follows:

  1. request a “certified copy” of the certificate from the Office of Vital Records or the Department of Health Services ( please note that marriage certificates that do not show the place and the date of birth of the bride and groom must also be accompanied by the “certified copy” of the “marriage application and license”, and that birth certificates cannot be “abstracts”);
     
  2. obtain an “apostille” from the Secretary of State that authenticates the signature of the U.S. official who issued the certificate (addresses of the Secretaries of State of this jurisdiction are attached);
     
  3. bring or mail* the above documentation to this Consulate General with one of the forms ( marriage , birth , death ) herewith attached and with the proof of citizenship mentioned on the form itself.

*DO NOT ASK THE U.S. OFFICE OF VITAL RECORDS TO MAIL THE   CERTIFICATE DIRECTLY TO THE CONSULATE

POSTING OF MARRIAGE BANNS

Information for Italian citizens who reside in the jurisdiction of the Consulate General of Italy in San Francisco, who are enrolled in the A.I.R.E., and who wish to be married in Italy.

GENERAL INFORMATION

§  Requests for the posting of marriage banns are governed by Articles I, II, and III of the D.P.R. 3.11.2000 n.396, which became effective on March 31, 2001.

§  Requests for banns to be posted must be presented by both parties or by a person who has been given a special power of attorney to do so.

§  A person who wishes to remarry (widow/er or divorced or with a previous annulled marriage) must ascertain that the information relating to his/her vital statistics and enrollment in the A.I.R.E. are up to date in their Italian city of birth, or of the last residence, or where their birth was recorded.

§       An Italian citizen who was born abroad must ascertain that his/her birth certificate has been recorded in Italy.

INSTRUCTIONS AND DOCUMENTATION

An Italian citizen who resides in this consular jurisdiction, and who is enrolled in the A.I.R.E., must call the Consulate to make an appointment with the person in charge of the procedure, in order to present his/her request for posting marriage banns. Both parties must appear in person if they reside here; if only the Italian citizen resides here then he/she must appear in person with a power of attorney given to him/her by the other party.

The requesters must come to the appointment with all the required documentation, in the original.


For the Italian citizen

§   Birth certificate in “estratto per riassunto, in formato internazionale”, with the names of the parents. For Italian citizens born in the U.S. the birth certificate must be a “certified copy” with an “apostille” (see attached list of addresses);

§   Italian passport (for Italian citizens born abroad, U.S. passport)

§  Resident alien card, or visa and (I-94), or U.S. naturalization certificate (for the Italian citizen born abroad, whose birth was not recorded through this Consulate, proof that his/her birth certificate was recorded in Italy- this may be an abstract of birth from the Italian comune or a statement from the Consulate of Italy that processed the birth certificate);

§  The attached request for posting of banns, in the form of an “autocertificazione”, completed and signed.

For the U.S. citizen*

§    “Certified copy” of the birth certificate with the “apostille” of the Secretary of State (see attached list of the addresses of the Secretaries of State of this jurisdiction);

§     United States passport;

§    “Atto notorio” issued by the Consulate General

*In the event that the non-Italian spouse is of a citizenship other than the U.S., different documentation may be required (call the Consulate for instructions).

PROCESSING TIME AND COSTS

Once the above procedure has been completed, the banns will be posted in the lobby of the Consulate for eight consecutive days. On the ninth day, the Consulate will issue a certificate of compliance and will mail it to the Comune in Italy where the marriage will take place.

The fee for the posting of banns is approximately $22.00, payable in cash, money order, or cashier’s check.
